Peak Fitness and Lifestyle Limited Membership Terms and Conditions


These Terms and Conditions apply to all members of Peak Fitness and Lifestyle Limited (“we”, “us”, “our”). By joining and using our facilities, you agree to comply with these Terms and our Membership Rules.


1. Membership Rules and Conduct


We maintain Membership Rules to help ensure the safety, comfort and enjoyment of all members and staff.


You agree that you will:

  • Attend a gym induction before first use, particularly if you are new to gym-based exercise.
  • Use a sweat towel and wipe down equipment after use.
  • Not take bags onto the gym floor.
  • Not make or receive phone calls on the gym floor.
  • Not take photographs or videos on the premises, or post content online that could identify another member without their consent.
  • Return all equipment to the appropriate storage areas after use.
  • Not drop or throw weights, including in free weight areas.
  • Store personal belongings in a locker while exercising.
  • Not leave belongings unattended on the premises.
  • Wear appropriate clothing and footwear at all times.
  • Use all facilities and equipment safely and as intended. Please ask a member of staff if you are unsure.
  • Inform a member of staff of any medical condition that may affect your ability to exercise safely.
  • Refrain from any activity that could cause harm to yourself or others.
  • Keep fire exits, emergency exits, disabled access doors and alarms clear at all times (except in a genuine emergency).
  • Behave respectfully and not act in an aggressive, abusive, intimidating, antisocial or threatening manner.
  • Not conduct personal training or coaching services for other members unless authorised by us.
  • Park bicycles only in designated or appropriate areas.
  • Dispose of litter in the bins provided.
  • Not enter or remain on the premises while under the influence of alcohol or drugs.
  • Not engage in any criminal activity while on our premises.
  • Not damage the premises or the property of the gym, staff, or other members.
  • Not force entry to locked areas.
  • Not eat on the gym floor.
  • Vacate the premises before closing time.


2. Breach of Rules and Termination


We reserve the right to suspend or terminate membership immediately and without refund if a member:


  • Seriously or repeatedly breaches these Terms or the Membership Rules, or
  • Behaves in a way that puts others, staff, or property at risk.


This does not affect any other legal rights we may have.


3. Opening Hours and Facility Availability


  • Opening hours are displayed on our premises and/or website and may change from time to time.
  • We may temporarily need to close from time to time or withdraw access to all or part of the facilities for repairs, maintenance, alterations, alternative use, operational or health and safety reasons
  • Where closures are planned, we will take reasonable steps to provide advance notice.
  • Temporary, reasonable or occasional closures do not entitle members to refunds, extensions, or compensation.
  • This clause does not affect your statutory rights under UK consumer law.
  • We reserve the right to close on public holidays, including (but not limited to) Christmas Day, Boxing Day, Easter, New Year’s Day, and selected Bank Holidays.


4. Membership Fees and Payments


  • Memberships are payable either:
  • As a one-off annual payment in advance, or
  • By monthly direct debit/standing order.
  • Monthly payments are taken on the first day of each month.
  • Joining fees are non-refundable.


4A. Changes to Membership Fees


  • We reserve the right to review and increase membership fees.
  • Any increase will be reasonable and reflect changes such as increased operating costs, improvements to facilities, or changes in services.
  • Members will be given at least one month’s written notice of any fee increase before it takes effect.
  • If you do not wish to accept the increased fee, you may cancel your membership by giving notice before the increase takes effect, without penalty (other than payment of fees due up to the cancellation date).


4B. Non-Payment of Fees


  • Membership fees must be paid in full and on time.
  • If a payment is missed, we reserve the right to suspend access to the facilities until payment is brought up to date.
  • If membership fees remain unpaid for 14 days or more, we reserve the right to cancel the membership.
  • We may take reasonable steps to recover any outstanding fees owed up to the date of cancellation.
  • Reinstatement of membership following cancellation for non-payment may be subject to payment of outstanding fees and a new joining fee.


5. Membership Cancellation and Freezing


  • To cancel your membership, you must provide at least one month’s notice.
  • Notice must be given in writing (email or other approved method).
  • Membership fees remain payable during the notice period.
  • If you need to freeze or cancel your membership for medical reasons, we may request reasonable evidence.
  • In such cases, you will not be required to pay a joining fee if you later restart your membership.


5A. Membership Freezes

 

  • Members may request to freeze (temporarily suspend) their membership, subject to the terms of their specific membership type.
  • Some membership types may allow freezes free of charge, while others may be subject to an administration or freeze fee.
  • The availability, duration, and cost (if any) of a freeze will be clearly communicated at the time of request or as set out in the membership details provided at sign-up.
  • Freeze requests must be made in advance and are subject to approval.
  • During an approved freeze period, access to the gym facilities will be suspended.
  • Memberships will automatically resume at the end of the agreed freeze period unless otherwise agreed in writing.



6. Personal Belongings


  • Personal belongings are brought onto the premises at your own risk.
  • We do not accept responsibility for loss, theft, or damage to personal items unless caused by our negligence.
  • Lockers are provided for temporary use only and must be emptied after each visit.


7. Limitation of Liability


  • Members use the gym facilities at their own risk.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.
  • We are not responsible for injuries resulting from misuse of equipment, failure to follow instructions, or failure to disclose relevant medical conditions.


8. Data Protection (UK GDPR)


We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.


  • We collect personal information such as your name, contact details, payment information, and health information (where relevant) for the purposes of:
  • Managing memberships
  • Processing payments
  • Communicating with members
  • Ensuring health and safety


  • Your data is stored securely and only retained for as long as necessary.
  • We do not sell your personal data to third parties.
  • You have the right to access, correct, or request deletion of your personal data, and to object to certain processing.

9. Governing Law


These Terms and Conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
